Why Proposed Food Safety Rules Could Hurt New England Farms

Small farms are part of the fabric of New England, and now – perhaps more than ever – consumers are devoted to supporting local agriculture in our region.  Unfortunately, some proposed federal regulations do not reflect these local values.  The Food and Drug Administration’s (FDA) proposed new food safety rules  impose confusing and cumbersome restrictions on farm operations in the name of food safety.  We are all in agreement that food safety is extremely important.  But the new FDA rules were designed with large-scale agriculture in mind, and are not compatible with the scale of agricultural production operations in New England. These rules are critically important – they will impact how food in New England and around the country is grown, handled, and processed. Whether you are a farmer, a food buyer or processor, or someone working toward a thriving and resilient New England farm and food system, you have a stake in how new food safety laws are implemented.

Massachusetts Fosters Electric Vehicles with New Municipal Program

Massachusetts Electric Vehicle Incentive Program DEP Municipal

Today the Patrick Administration took an important step toward meaningful deployment of electric vehicles (EVs) in Massachusetts. Building on momentum from the Massachusetts Electric Vehicle Roundtable that CLF co-hosted with the Administration in March, the Patrick Administration launched a new incentive program yesterday: the Massachusetts Electric Vehicle Incentive Program for Municipalities. The Administration announced this new program on Earth Day at events in Greenfield and Chelmsford. CLF attended the announcement, and you can watch a video clip of MA Department of Environmental Protection (DEP) Commissioner Kimmell and MA Executive Office of Energy and Environmental Affairs Secretary Sullivan announcing the new program in Chelmsford here and here (pardon the occasional wind!).

Following the MA EV Roundtable in March, the Administration created the Massachusetts Electric Vehicle Initiative to promote EVs in the Commonwealth. The new incentive program, focused on helping increase use and visibility of EVs in Massachusetts towns, is a noteworthy first step for the MA EV Initiative. This program will help municipalities purchase EVs as well as fund installation of charging stations. The program offers $7,500 grants per EV and $15,000 per publicly accessible charging station to eligible communities. The program, which is administered by the MA DEP,  has $2.5 million available for these grants.

At yesterday’s Earth Day launch for this program, Secretary Sullivan noted that increased deployment of EVs is an essential step toward meeting the climate commitments contained in the MA Global Warming Solutions Act (GWSA). Increased EV deployment is indeed an important step if the Commonwealth is to meet its mandatory greenhouse gas emission (GHG) reduction targets, and CLF is pleased to see the Commonwealth taking initiative with this measure. At the same time, the big picture for GHG reductions in Massachusetts still requires significant progress that can only be achieved through markedly stepped up action. The Administration has not met the GWSA’s deadlines for adopting and implementing regulations to reduce GHGs commensurate with the requirements of the GWSA across all sectors – including transportation. While steps to promote EVs will help move the needle, the newly announced Initiative must complement, rather than serve as a substitute for, much more expansive action that is urgently needed across the transportation sector and beyond.

The Commonwealth’s press release following the launch indicated that this program “is the first of what the state plans will be other state incentive programs to increase electric vehicle deployment and ease their use.” CLF is pleased that the Patrick Administration is taking its commitment to fostering meaningful deployment of EVs in Massachusetts seriously, applauds the Commonwealth for this important first effort, and is optimistic for meaningful next steps for the MA EV Initiative. We hope that the successful launch of this program will help fuel a broader effort to reduce GHGs and ‘green up’ all of our transportation options!

BU Biolab Case Returns to Court

CLF and affected community residents will be back in Court on April 11th arguing that the high-level biocontainment laboratory proposed by Boston University (BU) has no place in the densely populated urban environmental justice community of Roxbury/ South End. Please join us in standing up for this important cause by attending the hearing in Boston on April 11th.

As we reported last year, having failed twice before, the National Institutes of Health (NIH) and BU have attempted for the third time to adequately explain how the risks associated with placing a high-level biocontainment laboratory (the “Biolab”) that would test pathogens like ebola and the plague are acceptable for an urban environmental justice community. NIH released its latest Risk Assessment in July 2012. For the third time, that Risk Assessment does not meaningfully address the fact that the Boston location selected for siting the NEIDL comes with substantially more risk potential than rural or suburban alternative sites. The final Risk Assessment also fails to fully analyze the ways in which the environmental justice community living near the NEIDL site would be unfairly affected by proximity to the facility. Unfortunately, however, NIH decided that the Risk Assessment was adequate to close out its investigation of the risks of this facility, and issued a final Record of Decision in January 2013. That Record of Decision is the trigger that brought the parties to this ongoing litigation back to Court.

In this case, six plaintiffs (five community residents and CLF), challenge the adequacy of NIH’s Risk Assessment and Record of Decision in the U.S District Court for the District of Massachusetts. Chief Judge Patti Saris of that Court will hear cross-motions for summary judgment, and the plaintiffs’ motion for a permanent injunction against the Biolab, on April 11th in Boston. You can read the plaintiffs’ brief here. Judge Saris’ findings from this hearing will be the final judgment in this case at the trial court level.

This hearing is a major milestone in the case against the Biolab, and community presence in the courtroom is powerful. If this issue is important to you, you need to be there. The details for the hearing are:

CLF Proposes Clean Energy Incentive for Electric Vehicle Purchases

Government officials, industry representatives, and environmental advocates agree: it’s time to increase the number of electric vehicles (EVs) on the road in Massachusetts. EVs emit significantly less carbon dioxide, carbon monoxide, and other pollutants into the air we breathe. Yet the market for EVs in Massachusetts is currently small, due largely to higher price tags, lack of incentives and little infrastructure. Thankfully, the enthusiasm at the recent Massachusetts Electric Vehicle Roundtable indicates that we are poised to do more for EVs in Massachusetts.

Earlier this month at the MA EV Roundtable, I described a new idea for encouraging EV purchasing in the Commonwealth that CLF has developed with Sonia Hamel of Hamel Environmental Consulting. The Clean Energy Bundle Incentive would provide purchasers of EVs free renewable electricity for charging their EVs at home. To achieve this, the state would purchase bulk renewable electricity and distribute it to interested customers as free energy. The state could ensure that the renewable energy, or the funds used to purchase the renewable energy, flows from existing Massachusetts renewable programs and efforts like the Renewable Energy Portfolio Standards (RPS). The state could choose to distribute the energy as either a direct rebate, in the form of a debit card, or as part of a contract. While the amount could be adjusted, we think that $2,000 is in the right ballpark for an amount to distribute per customer.

Bundling free, clean energy with the purchase of an EV stands out as an excellent option to incent EV purchases in Massachusetts. CLF believes that purchasing incentives are key to meaningful deployment of EVs in Massachusetts, and  we favor incentives that set new energy use paradigms, increase market alignment, and are educational for consumers. The Clean Energy Bundle Incentive achieves all three of these goals.

CLF believes the Clean Energy Bundle Incentive will be an effective incentive in the current EV market, and is bolstered by a study by McKinsey and PlanNYC on EVs in New York City. That report found that due to the still-fledgling market of EVs, lack of infrastructure, and small number of potential purchasers, incentives should target “early adopters,” a group committed to investing in green technology and being recognized for their investment. The Clean Energy Bundle Incentive targets these “early adopters” by doubling their investment in green technology, as their EV will run on renewable energy.

While the Clean Energy Bundle Incentive is a new concept for EVs, the idea has been piloted in the realm of natural gas vehicles. Honda is currently offering a $3,000 debit card for use at any Clean Energy brand gas station with the purchase of a Honda Civic Natural Gas, which gives the average owner about three years worth of fuel.

CLF Holds Successful Massachusetts Electric Vehicle Roundtable with Patrick Administration

Last week, CLF co-sponsored the Massachusetts Electric Vehicle Roundtable with the Commonwealth of Massachusetts and Clean Cities. The invitation-only event resulted in 90+ RSVPs from government officials, business and utility representatives, advocates, and others, and was very well attended despite the ever-worsening weather forecast. Opening remarks from Executive Office of Energy and Environmental Affairs Secretary Rick Sullivan and CLF President John Kassell set the tone for a productive day, and clearly established the Patrick Administration’s commitment to promote Electric Vehicles (EVs) in Massachusetts. You can watch their opening remarks here. We were also joined by several environmental and energy agency commissioners: Department of Environmental Protection Commissioner Ken Kimmell, Department of Energy Resources Commissioner Mark Sylvia, and Department of Public Utilities Commissioners Dave Cash and Jolette Westbrook. Key staff from the Massachusetts Department of Transportation also attended.

Going into this event, we knew that the stage has been set through strong state clean energy and climate policies, and that the time is right for Massachusetts to affirmatively promote a robust market for EVs. We have only 900 or so EVs registered in our state, so we have a long way to go to catch up to current leaders in this arena, such as California. In fact, Vermont has at least twice as many EVs as MA per capita. It’s not hard to understand why this is the case – while MA is usually a leader in environmental and energy policy initiatives, states like Florida, Georgia, and both Carolinas (and many others!) currently have more incentives for potential EV consumers than we have in Massachusetts. These types of incentives are critical to the success of new energy technologies such as EVs.

Given that electric vehicle deployment will be an important means of achieving our mandatory climate reduction goals in Massachusetts (25% below 1990 greenhouse gas levels by 2020, a third of which should come from the transportation sector, and 80% by 2050), we cannot afford to wait to do more. Throughout the Roundtable, CLF and other presenters articulated the many policy opportunities, and opportunities for industry and utility stakeholders, to make EVs viable in Massachusetts – from purchasing incentives, to convenience benefits like access to HOV lanes, to time-of-use charging to reduce impacts to the electric grid from increased EV deployment (and reduce charging costs even more).

Overall, the day was very energizing and inspiring, and we expect real outcomes in the near future. We regret that we couldn’t open up the event to the public, but in addition to watching the opening remarks here and below, you can review the agenda and powerpoint presentations from the Roundtable. We look forward to exciting developments coming out of this energizing day, and promise to report back here on our progress.

 

 

 

CLF Breaks Local Bread in Celebration of Food Day 2012

On October 24, CLF will join with people around the country to celebrate Food Day as part of a nationwide movement for healthy, affordable, and sustainable food. This is a time for us to gather and reflect on the agricultural abundance our region can provide, and the importance of making sure that our food systems not only supply bodily nutrition, but  also contribute in a healthful way to our community ecosystems.

At the smallest scale, CLF’s Boston staff will celebrate Food Day by breaking local bread (and cheese!) from Allandale Farm and sharing in the story of one urban community fighting for food justice: we’ll be getting together to watch The Garden, a documentary about the community’s fight to save a14-acre community garden in South Central Los Angeles from being sold for development. This important story reflects the struggles that many of our communities of color and low income communities face in order to gain access to a basic right: nutritious food. (For more on CLF’s Farm & Food work, check out this page.)

But CLF’s celebration of healthy, affordable, and sustainable food is not limited to October 24th. CLF attorneys working on our Farm and Food Initiative work year round to protect, expand, and improve our regional food system, tackling some of our region’s most pressing environmental and health issues, and making our region more resilient to the impacts of climate change already underway.

From our efforts in Vermont working with farmers and other professionals to demystify community-financing tools available to farmers seeking to start, or grow, their farms, to our study of policy and market barriers related to urban agriculture in Greater Boston, CLF and CLF Ventures’ Farm and Food work is both advocating sustainable farming practices and unlocking the economic development potential of agricultural development. And this is just the beginning: over the next two years, CLF will engage in the most comprehensive regional policy analysis that has ever been done for commercial agriculture in New England, leading to a suite of policy recommendations that will enable our region to develop a self-supporting food system.

CLF understands that food lies at the intersection of many of our most pressing problems – the obesity epidemic, soaring healthcare costs, a faltering economy, climate change, and social inequity. We hope you’ll not only join CLF in celebrating Food Day on October 24 (check out activities in your area here), but continue the journey with us as we advocate solutions that bring healthy food to all of New England’s communities using sustainable farming practices and reducing the impacts of climate change.

Review Process for BU Biolab Revs Up Again

Many of you have been waiting for the next opportunity to voice your concern over the BU Biolab. Your time is coming – the state’s public comment process will begin soon, and the Patrick Administration needs to hear from you.

The proponents of Boston University’s proposed National Emerging Infectious Diseases Laboratories (NEIDL) – known as the BU Biolab – in the densely populated urban environmental justice community of Roxbury/ South End are in the process of submitting the risk analysis of their project for environmental review. Having failed at this twice before – in the view of the Massachusetts courts and the National Research Council, among others – this is the third time  the National Institutes of Health (NIH) and BU have attempted to adequately explain how the risks associated with placing a a high-level biocontainment laboratory that would test pathogens like ebola and the plague are acceptable for this community.

The latest Risk Assessment, which was recently completed by NIH, is now under final consideration by that same agency pursuant to the National Environmental Policy Act (NEPA). CLF has reviewed the final Risk Assessment and, like NIH and BU’s past attempts, it still falls extremely short of addressing concerns about the lab raised by community members.

In particular, NIH’s final Risk Assessment  does not meaningfully address the fact that the Boston location selected for siting the NEIDL comes with substantially more risk potential than rural or suburban alternative sites. The final Risk Assessment also fails to fully analyze the ways in which the environmental justice community living near the NEIDL site, which already battles disproportionately compromised health, would be unfairly affected by proximity to the facility – which unfortunately has great potential for disaster in the event of an accident or malevolent attack. BU will soon submit its Risk Assessment for review by the state pursuant to the Massachusetts Environmental Policy Act (MEPA), at which point the public will have the opportunity to comment. Public input is the heart of the environmental review process. It is essential that the Patrick administration hear why this facility presents too much risk, and not enough benefit, for this already overburdened environmental justice community. Progress on the Road to a Regional Clean Fuels Standard

New Englanders are driving and emitting more pollution every day. Emissions from New England’s transportation sector – the fastest growing emissions sector — produce about 40% of the total greenhouse gas emissions in the region, more than half of which comes from passenger cars. This is a problem for New England’s people, environment and economy.

That is why CLF has been working hard with a coalition of environmental advocacy organizations to support the creation of a Clean Fuels Standard (CFS) in eleven Northeast and Mid-Atlantic states. A successful CFS would achieve several mutually reinforcing goals:

  • Reduce greenhouse gas emissions from the transportation sector through the promotion of alternative fuels (such as electricity, advanced biofuels, and natural gas);
  • Drive regional economic growth; and
  • Ensure energy security and insulate residents of the Northeast and Mid-Atlantic states from rising oil prices.

This week, the CFS advocacy coalition – comprised of CLF, PennFuture, Environment Northeast, Environmental Entrepreneurs, Natural Resources Defense Council, Sierra Club, Union of Concerned Scientists, Environment America, and Ceres – welcomed good news regarding litigation in California over the CA Low Carbon Fuel Standard (LCFS). On Monday, the Ninth Circuit Court of Appeals granted a motion to stay sought by the State of California and its co-appellants (including CLF, who is a party to the CA litigation). This decision blocked the injunction granted by the U.S. District Court for the Eastern District of California, which prevented CA from enforcing its LCFS regulations while the appeal was pending.

In real terms, as a result of the Ninth Circuit’s decision, the LCFS will be alive and well in CA while the Appeals Court considers the merits of the case – a significant victory for California, CLF, and the other appellants, and a positive step toward combating climate change in the transportation sector.

CLF and its partners also made important strides this week toward promoting a regional CFS by standing up against threats from the Consumer Energy Alliance (CEA), a trade association comprised of fossil fuel interests and affiliated with organizations like the American Petroleum Institute. CEA (along with the American Fuels and Petrochemical Manufacturers, American Trucking Associations, and the Center for North American Energy Security), is an opposing party in the California litigation described above.

Earlier this month, the CEA contacted Attorneys General in all of the states participating in the Northeast/Mid-Atlantic CFS program, spreading misinformation about the California litigation and threatening to lodge a similar battle against a CFS program in our region. CLF and its allies responded strongly with a response letter to the Attorneys General, making clear that CEA severely mischaracterized the direction of the CA litigation and its implications for the Northeast/Mid-Atlantic region. In fact, the CA litigation is not a predictor of the legality of fuel standards still under development in other locations, and resource-specific regional differences between the Northeast/Mid-Atlantic region and California undercut CEA’s claims. CLF believes that a regional CFS is a crucial means of significantly reducing the region’s dependence on oil, transportation costs, and greenhouse gas emissions while at the same time providing consumers more choices. CLF will continue to work with allies to ensure that the CFS program progresses in the Northeast and Mid-Atlantic states.

Speak Up: Public Comment Period Opens for BU Bioterror Lab

Boston University (BU) and the National Institutes of Health (NIH) are preparing a mandatory revised risk assessment for BU’s National Emerging Infectious Disease Laboratories (NEIDL), which has received substantial federal funding through NIH. I described the specifics of this risk assessment in an earlier post. The draft of that risk assessment is currently ready for public review. Though we reported in our last post that the public hearing for NIH’s draft risk assessment would be held February 16, that hearing was delayed by NIH. NIH recently announced that the hearing has been rescheduled for April 19 and that they are accepting public comments on the draft risk assessment. Your input in this public process is crucial – here is how you can get involved:

  • Review the Draft Risk Assessment: The first step is to review what NIH has prepared. You can access the draft risk assessment electronically here, and the accompanying Reader’s Guide here. You can also obtain a hard copy of the draft risk assessment and Reader’s Guide in the mail by e-mailing NIH at NIH_BRP@od.nih.gov or calling (301) 496-9838 to place your request.
  • Submit Written Comments: Any member of the public can submit comments to NIH on the draft assessment – that means you! The public comment period closes on May 1, 2012. After reviewing the draft risk assessment, submit your comments to NIH by May 1st via email at NIH_BRP@od.nih.gov or in hard copy to: The National Institutes of Health, ATTN: NEIDL Risk Assessment, 6705 Rockledge Drive, Suite 750, Bethesda, MD 20892.
  • Attend the Hearing: The public hearing on the draft risk assessment has been rescheduled for Thursday, April 19, 2012, from 6:30-9:30 PM at Roxbury Community College, 1234 Columbus Avenue, Boston, MA 02120. This is your opportunity to offer comments on the risk assessment verbally. We strongly encourage you to support the local community members opposing this project by attending this public hearing – either to offer comments yourself, or to offer support through your presence. If you would like to offer oral comments, you will need to sign-in prior to the start of the meeting. You can sign-in beginning at 5:30 PM.

Your written and oral comments can be as long/detailed or brief/big-picture as you like – there is no one way to express your opinion. The important thing is that you speak up.
