Regional Greenhouse Gas program is a win for the economy and environment – so let’s do more!

A study released today documents the powerful benefits of the Regional Greenhouse Gas Initiative (RGGI) – the nation-leading effort by Northeastern and Mid-Atlantic states to reduce greenhouse gas emissions from power plants while building up energy efficiency and clean energy efforts in the states.

The study found that RGGI created $1.6 Billion in net economic benefits across the region ($888 million in New England alone).  The program saved electricity customers $1.3 Billion on their energy bills region-wide due to investment by the program in energy efficiency and created 16,000 Job Years (a standard measure of employment) during the first 3 years of the program (including temporary and permanent positions).   The cost of the program was minimal, creating an imperceptible 0.7% electricity price increase on customer bills across the region that was more than offset by the benefits of the program.

CLF has been deeply involved with the RGGI program from its inception. We strongly believe that this is solid proof that RGGI, while first and foremost an effort to reduce greenhouse gas emissions, is also a win for the economy, consumers and business, as well as the environment.

We must apply the lessons of RGGI to date and move beyond this pilot phase, scaling up the program to further reduce pollution, create even more jobs and reduce energy bills on a much greater scale, and take this effort into other parts of the nation.

RGGI has proved that a well-designed greenhouse gas reduction policy is a win for just about everybody.  The complaints (amplified by their well-financed megaphone) from the filthy few companies who make their money by extracting and selling coal and oil, at great cost in lives and environmental damage, should not distract us from hearing that very positive story.

Counting Down to Shark Week 2012

I really do love our New England sharks. But I also love to surf. And as the water temperature at my favorite break is going down, the great whites are heading south. One less thing to worry about as I struggle with frigid water, thick head-to-toe neoprene, and my own personal resolve to surf all year long.

Out of sight may be good news for a surfer like me, but it’s important that we don’t let these magnificent creatures get out of mind. With Shark Week 2012 still 263 days away and counting, I am resolved to do occasional posts of shark news, facts and conservation updates to help get us through the long, sharkless months ahead.

So to kick things off, here are a few of my favorite current events, a la shark:

  • Taiwan will no longer allow shark finning, starting next year. Hopefully this type of ban will become more prevalent, and our important apex predator will be allowed to grow in size and number and help our oceans thrive. If you’re not sure you want more sharks, and bigger ones at that, consider the incredibly important role they play in our marine ecosystems. In short, they help preserve a healthy balance of species, from other large fish, on down to clams and oysters.
  • And a great local story: the Cape Cod Shark Hunters. Don’t worry, they don’t hunt to kill. They track down “The Landlord” (surfer nickname for great whites) and tag it. Then scientists from Woods Hole and the Massachusetts Division of Marine Fisheries track them to learn more about their habits, and to help us know when it isn’t safe to go in the water. I love their slogan: “Tag a shark, save a tourist!”

What are Friends For?

When three leading environmental organizations seek to get involved in a federal court case about a proposed development project, it’s not usually on the side of the developer. But, this week, CLF, NRDC and Mass Audubon filed a motion to participate as “Friends of the Court” in support of the defendants in five pending federal cases challenging federal approvals of the Cape Wind offshore wind energy project. The plaintiffs, unsurprisingly including the Alliance to Protect Nantucket Sound, are seeking to overturn the federal government’s 2010 approval of the landmark offshore wind project, the first to be approved in the United States.

Our federal court filing comes after more than a decade of exhaustive review undertaken by state and federal authorities, and by CLF and our colleagues in the environmental community – review that served to ensure Cape Wind’s approval was based on sound science and data, and that the project was thoroughly vetted through an open and transparent public process. Our support for the project reflects our findings that Cape Wind’s benefits far outweigh its impacts.

Between CLF, NRDC and Mass Audubon, we pack a couple hundred years of environmental advocacy and stewardship experience.  Collectively, we represent hundreds of thousands of Americans, from nearby Hyannis to far-flung Hawaii, who believe our country should prioritize a true clean energy agenda and move more quickly to deliver on the environmental, public health, energy security and economic benefits of responsible renewable energy. Backing the developer in the Cape Wind case may, at first blush, go against the grain of environmental advocacy history. But in this case, it is fully consistent with our longstanding missions to protect natural resources and public health – here, by advancing a key project that will begin to unleash the tremendous potential of offshore renewable energy, allowing Massachusetts and the region to dial back polluting fossil fuel power generation.

In late October, Senator Scott Brown called for the resignation of NOAA administrator Jane Lubchenco. CLF’s Peter Shelley wrote the following Letter to the Editor of the Boston Globe in response to Senator Brown’s statement:

Call to oust chief of NOAA is bad for a fishing industry in flux

SENATOR SCOTT Brown’s call for the resignation of the administrator of the National Oceanic and Atmospheric Administration is misdirected and destructive to a changing fishing industry that needs predictability, not political theater (‘‘Citing ‘indifference,’ Brown says NOAA chief should be fired,’’ Metro, Oct. 23).

Brown seems to think that the catch-share program was forced on Massachusetts fishermen by NOAA and Jane Lubchenco. In fact, the approach of having sectors of boat owners manage their fish quotas was developed and approved by the New England Fishery Management Council with unanimous support from the council’s Massachusetts fishing industry members and Governor Patrick’s representative. NOAA adopted the council’s plan without change. Eighteen months in, with some promising results and no quantitative evidence of an economic emergency, the council continues to support the catch-share program.

Brown’s call for Lubchenco’s head may curry favor with some frustrated Massachusetts groundfishermen, but it won’t solve their problems. What they do need is economic stability and confidence that their concerns will be addressed in full by the New England council. Its efforts to build on the program’s successes and mitigate its negative impacts are already underway with the full support of NOAA and Lubchenco.

If Brown is really concerned about the fate of Massachusetts’ fishing industry, he’d be better off seeking to end the congressional stalemate that is prolonging the national economic crisis than creating a bogus enemy in Lubchenco.

CLF Welcomes Zak Griefen in Newly Created Role of Environmental Enforcement Litigator

CLF is pleased to welcome Zak Griefen, a Vermont native and former litigator for Cheney, Brock and Saudek, in the newly created role of environmental enforcement litigator. Based in CLF’s Vermont office, but working on cases throughout New England, Zak will be focused initially on cleaning up our region’s inland and coastal waters by ensuring that polluters are aware of their Clean Water Act permitting requirements and bringing federal litigation when necessary. The environmental enforcement litigator position was created to hold polluters accountable for the violations of environmental regulations—Clean Water Act and others—that are rampant across New England, compromising our region’s health and the health and safety of our citizens.

Zak has a BA from the University of New Mexico, and earned his JD, cum laude, and Master of Studies in Environmental Law, magna cum laude, from Vermont Law School in 2005, where he was an editor of the Vermont Law Review. Admitted to practice in VT and MA, he served for two years as clerk to the judges of the Vermont Environmental Court, and then practiced civil litigation in Montpelier, where he lives with his wife and two children. Zak, who served as a summer intern at CLF in 2004, is an avid angler and is particularly interested in protecting healthy streams and promoting sustainable land use.

New Report Details Scope of MA’s Transportation Funding Woes

A new report released last week by Transportation for Massachusetts, a broad coalition of which CLF is a founding member, details the origins and scope of the transportation financing crisis in Massachusetts. Written as a primer to achieve better understanding among decision-makers,  taxpayers and transportation users, “Maxed Out” provides illuminating background amidst an increasingly urgent call for solutions to one of the Commonwealth’s most pressing problems.  The report emphasizes that the lack of revenue to maintain the Commonwealth’s transportation system in its current condition, let alone meet future needs, jeopardizes jobs, the environment, and the quality of life across the state.

The report details how the state’s long dependence on borrowed money unsupported by new revenue to pay off the debt has left all pieces of the state’s transportation network increasingly unable to fund operations, maintenance or construction projects.  Citing a recent analysis by the Transportation Advisory Committee to MassDOT, the report states that “45 percent of the combined annual operating budgets of MassDOT and the MBTA will go to pay off debt, not to operate and maintain current systems, let alone expand them.”

The release of “Maxed Out” and another transportation financing analysis also released last week by the non-partisan think tank, MassINC, follow recent remarks by Lt. Governor Tim Murray that “everything is on the table” when it comes to solving the transportation financing problem in the state.

Beacon Power bankruptcy: NOT “another Solyndra”

The unfortunate news that Beacon Power, an innovative technology company based in Massachusetts,  declared bankruptcy has inspired a bit of a media feeding frenzy centered around analogies to the failed California solar company Solyndra,  because Beacon (like Solyndra) received  a federal loan guarantee.

This analogy simply doesn’t hold up for the following reasons:

  • Beacon Power has a fully operational facility in Stephentown New York that is an operating model of their flywheel technology, a innovative technology that provides an essential service to the electricity grid, providing stability to the power system at a very low cost.  This stability will allow smoother operation of the power grid and allow for integration of many more renewable resources like wind and solar smoothly at a reasonable price.
  • The Federal loan guarantee is structured in a way that protects the financial interests of the taxpayers – giving them the right to be repaid out of the assets of Beacon before other companies and people that are owed money.
  • Unlike Solyndra, which was effectively losing a price competition with Chinese and other US manufacturers, Beacon makes a unique product that is being developed here in the United States.
  • The Federal Energy Regulatory Commission, a mere 11 days ago, issued a detailed rule that requires utilities to compensate companies like Beacon that provide power system stability in a competitive manner.  This sets a clear trajectory for Beacon, and the handful of other companies providing similar services, to be economically successful.

Given the assaults on the environment and climate and continuing economic and social disruptions there is enough bad news out in the world without alarmist voices generating scary stories because of events like the Beacon bankruptcy.   While it is an unfortunate event for some private investors and employees of Beacon it is not a crisis for taxpayers and can and will not stop the development of innovative and important technologies that will be the backbone of a new clean energy economy.

Rally for the Green Line Extension on October 20 at 6PM

Are you tired of waiting (and waiting and waiting) for the Green Line Extension to be built? Join CLF, the mayor of Somerville,  Joseph A. Curtatone, and other supporters of the Green Line Extension for a mock groundbreaking on Thursday, October 20, 2011 at 6pm in front of Somerville High School.

We are gathering to let the Patrick Administration know that we want them to stop the repeated delays and deliver on their legal commitment to construct the Green Line extension.  The Legislature has already authorized bonds to construct the Green Line Extension from Cambridge to Somerville and Medford and the Somerville Community Path.  The project will serve a community that has been dissected by a major highway (I-93), suffers from disproportionate air pollution, and lacks adequate public transportation. However, this summer, the State announced that it will again delay the construction of the Green Line Extension, by another four to six years, without providing any clear explanation why.

Public transportation projects in Massachusetts are chronically underfunded, despite the evidence that investment in a good transportation system creates jobs, boosts economic growth, reduces greenhouse gas emissions, increases energy independence, and improves quality of life for transit users and drivers alike. Still, funding for public transportation, bike paths, and sidewalks has never been strong enough, and continues to diminish rapidly.  Come stand with your fellow citizens and let our political leadership know that we want a modern, safe, accessible transportation system that works for Massachusetts.

Immediately following the rally, we will take our numbers inside to attend the public hearing regarding the delays on the Green Line Extension to be held at Somerville High School beginning at 6:30pm.
