CLF Intervenes in Proposed NU/NSTAR Merger

CLF has intervened in proceedings regarding the proposed merger of Northeast Utilities (NU) and NSTAR, which combined would create the third largest utility in the country and the largest in New England. CLF has intervened in the proceedings before the Massachusetts Department of Public Utilities (DPU) to ensure that the merger will only be allowed to go forward if it is “consistent with the public interest.”  This will require a thoughtful analysis of the merged utility’s long-term strategies for delivering energy while fully meeting the greenhouse gas emission reductions, renewable energy and energy efficiency requirements of the MA Global Warming Solutions Act and Green Communities Act.  It also will require a close look at the economic and environmental risks posed by the energy generation assets that would be owned by the merged utility.

One of CLF’s concerns is that NU subsidiary Public Service of New Hampshire (PSNH) owns and depends upon outdated, inefficient coal- and oil-fired power plants. These plants – which are obsolete and increasingly more expensive and less economic to operate – present risks and liabilities that would be spread to NSTAR’s ratepayers if the merger goes forward.  Another concern is that the merged utility might seek to weaken Massachusetts’ renewable energy standards, as suggested in some of the utilities’ public statements, allowing large hydropower to “flood” the market (pun intended!) and chill development of other renewable energy sources such as small wind and solar facilities.

Currently, the procedural schedule for the merger proceeding pending before the Massachusetts DPU has been suspended while the DPU considers whether to modernize the legal standard it will apply.  CLF and other parties have asked that the legal standard be adapted to account for changes in relevant laws, including the Global Warming Solutions Act and Green Communities Act.

Avoiding false choices – seeing the value of the Regional Greenhouse Gas Initiative

One of the easiest ways to make bad decisions is to allow ourselves to be drawn into a false choice – to see two options as an “either/or” where seeking one goal means stepping away from another. This can be a false choice because, fortunately, sometimes making the right decision will yield a double benefit.

When we have an opportunity to reduce energy use and harmful emissions while building jobs and the economy we encounter that kind of golden moment: when the right choice yields double, triple and even quadruple benefits.

There are people who will reject this formulation – who will present that most fundamental of false choices: the flawed argument that making the right choice for our environment and the public health is bad for the economic health of our communities and building jobs.

We are surrounded by proof that economic benefit flows from the same actions that reduce dirty energy use and emissions. The nation-leading energy efficiency programs funded by the Regional Greenhouse Gas Initiative (RGGI) which have created jobs while slashing the energy bills of families and businesses of the Northeast is a prime example.  A recent report issued by the states participating in RGGI (described here) provides hard numbers documenting this happy phenomena.

But we can do far better – and we need to if we are going to address the fundamental challenge of global warming and if we are going build the new economic base that can provide jobs and financial security for the future. Building that cleaner and more secure future will mean building on the successes of RGGI, making it more effective in reducing emissions and creating even more investment in energy efficiency so it slashes even more customer bills and creates even more jobs.

This time, it’s permanent: Somerset Station power plant shuts down for good

Massachusetts moved one step closer to a coal-free future this week as NRG, owner the Somerset Station power plant located in Somerset, MA, announced that it will shut the plant down permanently, effective immediately. The 85-year-old plant shut down initially in January 2010, after CLF and Somerset residents brought an appeal with regard to NRG’s plans to repower the plant using an experimental technology known as plasma gasification. Earlier this month, NRG asked the Massachusetts Department of Environmental Protection (MA DEP) to withdraw approvals for those plans, saying the company had decided not to pursue its plasma gasification project that would have used fuels including coal, construction and demolition debris and woody biomass. Finding funding for MBTA improvements from a nearby source: Logan Airport

The delays commuters suffered through during the recent cold weather spell have rudely exposed the MBTA’s decaying infrastructure and serious underlying financial problems.  Many of the MBTA’s vehicles are long beyond their useful life. Because of a lack of funding, the MBTA is forced to spend money to hold these vehicles together rather than to invest in new ones, which in the long run is a great waste of resources.

A February 13 editorial in the Boston Globe points to a source of funding that could be used to help address these problems: Logan Airport’s annual parking-fee revenues.  This is a great idea, considering the airport is one of the biggest beneficiaries of both the transit system and the Big Dig, but has only contributed a limited amount of resources so far. The value of transit system to the airport could easily be monetized through determining how many riders on the Blue and Silver Lines, for example, travel to and from the airport.

Maybe we can get a conversation going before the snow melts—our public transportation system is too important for the economic, environmental and social goals of the Commonwealth to endure further delay.

Dominion takes next key step towards shutting down Salem Harbor Station power plant

One small step for man, one giant leap for coal–or lack thereof. Under pressure from public health groups, environmental organizations, political leaders and community members, Dominion Energy of Virginia has taken another important step toward closing Salem Harbor Station, its 60-year-old, coal-fired power plant in Salem, Massachusetts. Known as a “non-price retirement” request, the move represents an official request to the electric system operator, ISO New England, to allow the plant to shut down permanently.

Shanna Cleveland, staff attorney for Conservation Law Foundation (CLF), said, “Dominion’s actions put Salem Harbor Station on a path to shut down by 2014. Combined with its recent statements to shareholders that it doesn’t intend to invest any more capital in the plant, it is clear that Salem Harbor Station cannot operate profitably. The only issue remaining is whether the plant will shut down sooner than 2014. An unprofitable plant is still a polluting one, as long as it operates.” More >

In his column in yesterday’s Boston Globe, Harvard economics professor Edward Glaeser illustrates that densely developed cities are better for the environment than leafy suburbs. The column correctly states that the average household in Boston’s urban core emits significantly fewer pounds of carbon dioxide per year, in part because people in the city drive less. Unfortunately, the column also states that public transportation “does little to balance the scales”— a statement that could easily be misinterpreted to mean that the use of public transit does little to decrease carbon emissions. In fact, Glaeser’s research that formed the basis for his conclusions indicates that although city dwellers tend to use more public transportation than suburbanites, their carbon footprint is still significantly lower precisely because the emissions from transit are modest relative to the contributions of cars. Travel by public transportation emits about half as much carbon dioxide per passenger mile than private vehicles, and uses about half the fuel.

Glaeser’s message is clear. If we’re going to minimize our carbon footprint, we need to not only support denser development in downtown Boston, but also greater investment in our underfunded public transportation system.

Good news from one of New England’s special ocean places – marine life recovering in closed area of Stellwagen Bank

Stellwagen Bank, outlined in red, is located only 25 nautical miles from Boston and three nautical miles from Gloucester and Provincetown.

Located at the mouth of Massachusetts Bay, only 25 nautical miles from Boston and three nautical miles from Gloucester and Provincetown, lies Stellwagen Bank, an underwater plateau that is home to a wide variety of marine life and is one of New England’s special ocean places. Stellwagen has been known for its highly productive fishing grounds since the early 1600s, and it is one of the few remaining hotspots of the Atlantic wolffish, a bottom-dwelling fish with a distinctive mouth full of sharp and wayward teeth that is facing extinction in the United States. However, because of its heavily-trafficked location and desirable biological abundance, Stellwagen has been faced with a multitude of human-induced pressures, leaving its ecosystems at risk. Species such as the wolffish, along with commercial species such as cod, are threatened when modern fishing gear is dragged along the bottom of the ocean, leveling the seafloor and destroying habitat features like biogenic depressions, burrows, nooks or small caves that allow fish to hide to catch prey, avoid predators, and protect their eggs.

In 1992 Stellwagen Bank was designated as a National Marine Sanctuary, which  meant that some harmful activities (including sand and gravel mining, drilling for oil and natural gas, and discharging pollutants) were prohibited – but all fishing activities were allowed to continue. In 1998, however, an amendment to the groundfish fishery management plan established a closed area in the Gulf of Maine (the Western Gulf of Maine Closure, or WGOMC) that overlaps Stellwagen and prohibits the use of particularly destructive bottom-tending fishing gear within its boundaries. (Recreational fishing and less-destructive commercial fishing are still allowed within the closure.) The idea behind this closure is that if gear that destroys the sea bottom is kept out, ocean wildlife and features on the seafloor will have the chance to rebuild and a rebuilt thriving benthic habitat will mean healthier fish stocks.

If the WGOMC has this desired effect, it will be important not only for the marine life within its boundaries, but also as an indication that this strategy should be replicated in other areas in need of protecting and rebuilding ocean communities and associated managed species. A recent NOAA National Marine Sanctuaries report compares protected areas within the WGOMC with areas of initially similar habitat type outside the WGOMC for the period 1998-2005 to see if the closure was indeed having a positive effect. What do the results say? Overall, the study’s findings indicate that the fish and wildlife inside the WGOMC closure area are recovering from impacts of destructive fishing gear. However, the report cautions that the seafloor community is changing over time and may not attain a stable state (in theories of ecology, ecosystems change over time until they reach a final, stable phase). Still, the WGOMC is recognized as an important area for conserving biodiversity, and the report concludes that the use of closures remains a valuable tool for maintaining ocean habitat. While this certainly indicates that further study of the WGOMC is needed and that recovery is not complete, it also supports the case for protecting vulnerable underwater habitats in order to allow our healthy ocean ecosystems to grow and thrive.

CLF announces intent to file a federal Clean Air Act citizen suit against owners of Mt. Tom Station coal-fired power plant

CLF today announced that it intends to file a federal citizen suit against Mt. Tom Generating Company, FirstLight Power Resources and GDF Suez North America, the owners of Mt. Tom Station, for ongoing violations of the Clean Air Act. Mt. Tom, a 50-year-old coal-fired power plant in Holyoke, MA, is one of the top five sources of toxic emissions in the state, and one of the plants targeted by CLF’s Coal-Free New England campaign.

“The soot Mt. Tom releases contains dangerous pollutants that threaten the health of everyone who breathes them–particularly children and the elderly,” said CLF staff attorney Shanna Cleveland. “Despite recent investments in new technology, this plant is unable to operate in compliance with the law, and therefore within the limits of what is considered safe for human health.” More >

CLF Negotiates Cool Solution to Get Kendall Power Plant Out of Hot Water (And To Get Hot Water Out of Kendall Power Plant)

Today marks a new milestone for CLF in our efforts to clean up the lower Charles River. Concluding a five-year negotiation, involving CLF and the other key stakeholders, the EPA issued a new water quality permit for the Kendall (formerly Mirant Kendall) Power Plant, a natural gas cogeneration facility owned by GenOn Energy. The plant is located on the Cambridge side of the Longfellow Bridge.

The new permit requires the plant to reduce its heat discharge and water withdrawal by approximately 95 percent, and to ensure that any heated discharge does not warm the river enough to cause harm.

The outcome is remarkable, not just for the dramatic improvements it will achieve in the lower Charles, but for the way in which the parties “got to yes.”

The plant will meet the new requirements by upgrading its existing “once-through” cooling system, to a new, closed-loop system. Kendall will capture most of the heat generated by the plant and distribute it as steam through a new pipeline to be built across the Longfellow Bridge over the next few years. The combination of the new co-generation turbine and expanded pipeline will allow Kendall to drastically reduce the amount of water it extracts from the Charles River, take more heat out of the plant, and double the amount of steam it can sells to heat buildings in the city of Boston.

It’s what’s known in the business as a “win-win situation.”

Today’s events would not have happened without the incredible efforts of two former CLFers: Carol Lee Rawn, who was a senior attorney in our Boston office, and Jud Crawford, who was senior scientist. They put together the case and the legal challenge to the Mirant Kendall permits based on a demonstration that EPA’s proposed heat discharges would threaten the fish and biological system in the lower Charles. They also showed that the proposed water intake damaged fish eggs, larvae, juvenile and adult fish and that better technologies were available in the market. CLF represented the Charles River Watershed Association (CRWA), who was the perfect conservation partner for our effort.

The outcome of this case has taught CLF a number of lessons. First, that being there is half the game. If we hadn’t appealed the EPA permit, none of this would have happened, no question. EPA and Mirant Kendall ultimately showed strong leadership qualities but needed a strong push. Second, that having a range of integrated advocacy initiatives can produce multiple, serendipitous results across the spectrum of CLF’s work in clean energy, clean water, ocean conservation and healthy communities. This single decision will create an opportunity for co-generation in an urban community, improve the health of our rivers and marine life, increase the quality of life for Esplanade users and river fishermen, and reduce green house gas emissions. Third, that a mix of good science and strong legal expertise is essential to our ability to make a credible challenge. And finally, that courtesy of all of the above and the generous and faithful support of our members over the past five years,  the Charles may one day be truly swimmable and fishable again.
