The Latest News about the Salem Harbor Power Plant

There has been a significant development in the long running saga of the Salem Harbor power plant, one of the major targets of CLF’s Coal Free New England campaign. On October 5, Dominion Energy, the plant’s owner, quietly filed what is known as a Permanent Delist Bid with ISO New England (ISO-NE), the operator of the New England electricity system and markets. The filing commits Dominion to permanently withdraw Salem Harbor Station from the forward capacity market, the key market where power plants, and other resources like energy efficiency, are paid to be present, available and ready to meet the electricity needs of the region.

What does this mean?

By filing to permanently withdraw Salem Harbor Station from the forward capacity market, Dominion is signaling that it does not believe the market will be able to provide sufficient revenue to run the plant profitably and that it cannot maintain the plant going forward.

According to Paul Peterson, senior associate at Synapse Energy Economics, Inc., “The delist process was created specifically to allow power plants to withdraw from the forward capacity market, either temporarily or permanently, depending on their economics. A power plant that enters a permanent delist bid – an irrevocable decision that it will no longer try to earn revenue from that key market – is laying the groundwork to shut down.”

Although there are alternative scenarios that could allow Dominion to re-enter the market at a future date, the barriers to re-entry are extremely high and the process for doing so is complex.

Excessive ratepayer burden

Dominion’s move puts additional pressure on ISO-NE to implement a plan by June 2014 that does not rely on Salem Harbor Station to keep the lights on – ever. On October 14, CLF filed a protest with the Federal Energy Regulatory Commission citing ISO-NE’s failure to develop such a plan following the 2009 and 2010 auctions, keeping Salem Harbor Station available for “contingency” needs at enormous cost to area ratepayers. In our protest, CLF pointed to insufficient planning and loopholes in the ISO-NE process that have allowed Dominion to receive more than $30 million dollars in above market payments just to continue to exist, even while Dominion’s own filings indicated its intentions to leave the market. The company filed “static delist bids” for the past two years, a temporary exit measure that allows a company to receive above market payments if it is deemed necessary for reliability. Dominion’s ability to repeatedly game the system has forced ratepayers to bear the cost of maintaining an obsolete and polluting coal plant well beyond its useful life.

Buckling under pressure?

Salem Harbor Station is under increasing economic and environmental pressure. In June 2010, CLF filed a federal lawsuit against Dominion for repeatedly exceeding smokestack emissions limits at Salem Harbor in violation of the federal Clean Air Act. The suit would hold Dominion responsible for paying millions of dollars in penalties retroactively. Meanwhile, new EPA regulations on the near horizon will mean tougher pollution controls and multi-million dollar investments needed to comply with them. The permanent delist bid is a clear indication that Dominion doesn’t believe it can continue to wring dollars out of ratepayers for its obsolete plant for much longer, and we are making sure they won’t. Portal to Offshore Wind Power: New Bedford named staging port for Cape Wind

At an event Wednesday afternoon in New Bedford, Governor Patrick, Congressman Frank, Mayor Lang, Secretary Bowles, Senator Montigny, DOER Commissioner Phil Giudice and a host of other local, state and federal officials together announced that New Bedford’s South Terminal will be developed as a deepwater port to serve the Cape Wind project and other offshore wind projects to follow.

It was a rare chance to celebrate the progress that has been made in bringing the nation’s first offshore wind project to fruition after so many years.  And it was striking to see longshoremen side-by-side with electrical workers, environmental advocates, renewable energy industry stakeholders, politicians and former politicians, such as former New Bedford Mayor John Bullard who long has championed the benefits of wind power — on land and offshore alike. The key message of the day was hammered home by speakers who highlighted the New Bedford wind port as a compelling example of the sort of convergence between economic and environmental objectives that we all seek.  Exactly.

Make Some Noise!

So the 100% biodegradable packaging that PepsiCo uses for its Sun Chips snacks is going away because … well, isn’t it obvious?!

PepsiCo is taking the no-waste, completely compostable, producer-finally-taking-responsibility-for-the- waste-it generates packaging off the shelves because WE complained that the packaging makes too much noise. It is hard to believe that we as consumers would make the conscious effort NOT to buy a product simply because the part of the product that we usually throw away is too loud. The trash trucks barreling down the side streets to pick up garbage (not too loud), the people living near landfills raising their voices to complain about rodents and odors and air quality (not too loud), citizen voices raised in anger to complain about higher taxes to pay for the higher costs associated with disposal of trash (not too loud), but a socially responsible package, designed to reduce our carbon footprint, our trash footprint, our costs …too loud?

It’s time to shut up and make some noise! Be Loud, Be Proud … and, p.s. buy a composter.

State Support for Electric Vehicles Gets The Green Light- But The Work's Not Done

Tomorrow, the Secretary of Energy and Environmental Affairs, Ian Bowles, will announce new state support for electric vehicles and the infrastructure needed to support them.  This is great news for the environment and the economy.

Electric vehicles are a vital piece of the puzzle when it comes to reducing greenhouse gas emissions and other harmful pollutants from the transportation sector.  These benefits are multiplied when electric cars are powered by clean renewable energy such as wind and solar.  In fact, electric cars are especially compatible with wind power which is often at its height when electric cars are charging at night.  Although these benefits are dampened in parts of the country where coal-fired power provides the majority of electricity, electric cars are still an improvement over the status quo.   So purging the system of old coal-fired power plants will maximize the positive impacts of these vehicles.

In addition, electric vehicles, like the Nissan Leaf will need charging stations, batteries, and maintenance—all of which will create solid, new green collar jobs.  One of the fastest growing electric car battery manufacturers started right here in Massachusetts, and with programs like the one at UMass Lowell (which is hosting the summit) and other leading educational institutions in Massachusetts, this sector will continue to grow and provide revenues and jobs for years to come.  This announcement is yet another sign of Massachusetts’ commitment to fight climate change by embracing innovative solutions.  It follows on the heels of, and will support the agreement entered into between Massachusetts and Nissan earlier this year.

Electric vehicles are one of the significant types of technologies that would benefit from the adoption of a regional Low Carbon Fuel Standard (LCFS) that is being developed by eleven Northeast and Mid-Atlantic states and would create a robust market for transportation fuels that are cleaner than petroleum.  Of course, electric cars are only one piece of the puzzle.  Increasing public transit, supporting smart growth, and reducing vehicle miles traveled are also essential to cutting the climate change impacts from transporation which is currently the fastest growing sector for greenhouse gas emissions.

Check out the work that CLF is doing to promote a regional low carbon fuel standard and increased public transit, and take action to support transportation solutions for the entire region.

October 8 is the deadline to adopt a mile of New England’s shoreline and we’re counting on you to make a difference.

Even if you never heard the term “nutrient pollution” before, you may have seen its devastating effects on the New England waters that you treasure. Slimy algae blooms and fish kills are two of the more visible consequences of too much nitrogen and phosphorus in the water. And the effects you can’t see are the most troubling: massive areas under the glistening waters of our fragile bays and lakes where no living thing can survive. This man-made problem is a solvable one and the key to our success is you!

Like you, I am frustrated by the dramatic and entirely avoidable scourge of nutrient pollution that is wreaking havoc on our most precious waters throughout the region, including Lake Champlain, the Great Bay Estuary, Cape Cod, Maine’s Coast and Rhode Island’s Narragansett Bay.

This week, CLF made big news by seeking stricter controls on nitrogen pollution (a form of pollution caused by inadequately treated wastewater) in the massive Millbury, MA wastewater treatment facility know as the Upper Blackstone Water Pollution Abatement District. Each day, this facility discharges more than 50 million gallons of nitrogen-laden water into the Blackstone River, which flows south through Massachusetts and eventually into Rhode Island’s Narragansett Bay.

The impacts of the nitrogen pollution in Narragansett Bay have been devastating. We’ve seen toxic algae blooms, widespread loss of eel grass meadows–critical habitat for fish and other marine life–and even massive fish kills. Rhode Island’s Department of Environmental Management estimates that one of the larger kills in recent memory left approximately one million dead fish on the state’s shores.

It doesn’t have to be this way–and fortunately, the problem of nutrient pollution is solvable. But the fight to tighten pollution controls at the Upper Blackstone and across the region won’t be easy, and that’s why we need you on board. Today, before midnight, you can make a difference by adopting a mile of shoreline for just $10.

Your donation will help push our clean water advocacy forward, not just in Rhode Island, but across the region. Just last month, CLF filed suit against the EPA for not fulfilling its duties under the Clean Water Act to permit and regulate the wastewater discharges on Cape Cod. In NH, as a direct result of CLF’s advocacy, the Great Bay Estuary has been officially designated as “impaired” under the Clean Water Act, affording it greater, much-needed protection from continued nitrogen pollution and the 20 wastewater plants in the area. Our advocates are on the ground taking the forceful legal action required to tackle this growing problem.

You may have never heard the term nutrient pollution before. But by adopting a mile of shoreline and making a difference in our clean water advocacy, let’s hope you never hear it again.

Dear CLF Supporter,

New England’s waters are in crisis. Nutrient pollution is a huge problem for our region; inadequately-treated wastewater, fertilizer-laden runoff from industrial farms, roadways, and sprawl development are fueling deadly algae blooms in some of our most cherished waters—like Lake Champlain, Long Island Sound, Cape Cod’s bay and estuaries, and the Great Bay, located between New Hampshire and Maine. These algae blooms suffocate and kill fish, shellfish and other aquatic life, creating vast “dead zones.”

Nutrient pollution is bad news. But there is a silver lining to this scummy, man-made problem: It’s solvable. For years, CLF has been working to reverse nutrient pollution in waters throughout New England. And there’s even more good news; today, you have the opportunity to make a REAL impact on nutrient pollution by symbolically adopting a mile of shoreline for $10:

Adopting a mile of shoreline may seem like a drop in the bucket, but it gives CLF and our advocates the resources we need to tackle and solve this problem; it is the very underpinning of our most crucial clean water work.

When you adopt a mile of shoreline for $10, you will fund:

  • Lake Champlain LakeKeeper Program: CLF’s LakeKeeper, affiliated with the Waterkeeper Alliance, is the eyes and ears of Lake Champlain, dedicated to protecting this irreplaceable natural treasure. Part watchdog, part scientist and part public advocate, the LakeKeeper engages citizens, businesses and state and local authorities in doing their part to keep Lake Champlain clean.
  • Clean Water Enforcement: All over New England, violation of water quality regulations is rampant, resulting in severely degraded waterways. Due to a combination of lax government oversight and insufficient resources, clean water can no longer be taken for granted. This is especially true in low-income communities, which bear a disproportionate burden of water pollution. CLF is putting feet on the ground to hold polluters accountable, wherever they are, for compliance with clean water laws in an effort to restore vital water quality to all New Englanders.
  • Nutrient Pollution Advocacy: Nutrient pollution is a relatively recent, man-made scourge—an insidious by-product of industrial agriculture and wastewater treatment operations—that is threatening New England’s great salt and freshwater bodies. It is also entirely solvable. CLF is tirelessly pursuing up-to-date, science-based limits on how much nitrogen and phosphorus can be discharged without sacrificing water quality and stricter controls at the source to keep the pollutants out of our waterways.

Nutrient pollution is a solvable problem and CLF is securing important victories all across our region. In Vermont, as a result of CLF’s advocacy, the city of South Burlington voluntarily cut in half the nutrient pollution that could be discharged into Lake Champlain from its sewage treatment plant. In Massachusetts, the EPA introduced controls for nitrogen in the 2008 permit for the Upper Blackstone Water Pollution Abatement District, over the objections of the district. The permit was recently upheld despite continued pressure from the district. The bottom line: Nutrient pollution, with your support, is a problem that we can solve!

Unfortunately, the clock is ticking. Literally. We are quickly approaching the point of no return for some of our region’s more fragile waterways. We need you to act now, before our October 8 deadline, to reverse nutrient pollution in New England. It takes just $10.

Cape Wind's movin' on up! CLF applauds MA court's decision to uphold permit

Today, the Massachusetts Supreme Judicial Court decided to uphold the comprehensive permit for Cape Wind’s transmission lines issued by the state’s Energy Facilities Siting Board (EFSB)–a welcome and much-anticipated milestone for the nation’s first major offshore wind energy project. CLF has been actively involved in moving the ball forward on Cape Wind throughout its nine-year review and permitting process, and we’re thrilled that Cape Wind will finally have an opportunity to to move forward and provide Massachusetts with clean, renewable power.

Here’s what CLF Staff Attorney Shanna Cleveland had to say on the subject:

“The Court thoroughly reviewed the extensive record in this case and correctly concluded that the state siting board rigorously scrutinized the project and fulfilled its obligation to safeguard the public trust. Cape Wind will provide electricity without producing any harmful greenhouse gas emissions, and its clean energy benefits are expected to significantly outweigh its impacts. The Court’s affirmation of Cape Wind’s comprehensive state permit is a significant step on the path toward a clean energy future for New England and the nation.”

A clear and accurate Republican voice

Using the authority given it by Congress in the Clean Air Act, and affirmed by the Supreme Court in the landmark case of Massachusetts v. EPA, the U.S. Environmental Protection Agency is moving to address the threat to the public health and environment from the greenhouse gases damaging our climate. But, as David Jenkins of Republicans for Environmental Protection describes on the Frum Forum website that effort is under attack by an effort led by Sen. Lisa Murkowski (R-AK).

The full piece is well worth reading but the punchline is of special interests to New Englanders who are represented by Senators Scott Brown (R-MA), Susan Collins (R-ME), Olympia Snowe (R-ME) or Judd Gregg (R-NH) who voted for Sen. Murkowski’s Dirty Air Act/Big Oil Bailout/EPA rollback the first time it got to the Senate floor:

Murkowski’s framing insinuates that her resolution is paving the way for Congress to take action . . . Unfortunately, that is not what is going on here . . . Murkowski has not been pushing at all for legislation to price carbon, and efforts by sponsors of such legislation to gain her support have been unsuccessful.

Instead she is putting all of her energy and passion into preempting EPA. “You attack it at all fronts,” Murkowski recently told Politico. “You go the judicial route. You go the legislative route.”

. . .

It is time for any member of Congress who still supports Senator Murkowski’s endeavor—or similar efforts—to drop all pretenses and tell the voters why they support the unfettered polluting of our life-sustaining atmosphere.

Moving renewable energy from Maine to Massachusetts

If you were listening to Maine Public Radio yesterday (whether because you are on vacation or because you live there) you might have caught this piece about plans to develop a sub-sea cable from Maine to Boston.

Bottom line: In order to meet the climate and energy goals that science and sound policy dictate we will need to build thousands of megawatts of clean renewable generation (as well as becoming much more efficient and many other key steps) and the infrastructure to support it.  And a sub-sea cable could be part of that solution, if it is done right.
