Best (and Worst) of the Beaches

While New England is home to many clean, scenic beaches, the sad truth is that hundreds of beach closures occurred in 2010 across the New England states.  Check out NRDC’s new report, Testing the Waters to see where your state ranked, and how clean your favorite beach was last year. (Spoiler alert: if you’re in Maine, Massachusetts, or Rhode Island, there’s room for improvement).

Why are these problems so pervasive?  Polluted stormwater runoff and sewage overflows are the major culprits – making beach closures more likely after it rains.  In Massachusetts, 79% percent of ocean beach standards violations happened within 24 hours after a rainstorm, according to the Massachusetts Department of Public Health.  

The solutions are not cheap – to tackle this set of problems problem will require a sustained commitment to fixing and improving underground sewer pipes, enlarging wastewater treatment plants, and installing green stormwater treatment to capture and clean runoff from roads and parking lots.  

The cost of doing nothing is also significant.  The US EPA estimated that in one year, 86,000 people lost a chance to swim because of beach closures in areas affected by stormwater pollution.

Clean water is essential to a thriving New England.  That is why CLF is applying legal leverage to improve management of sewage and stormwater runoff across the region.  We’re working toward a day when the pollution that causes beach closures will be a thing of the past, and swimmers will have their pick of beautiful New England beaches – whether or not it’s recently rained.

City of Portland gets one of its dirtiest little secrets out of the sewer and into the spotlight

Last night, the Portland City Council took a big step forward in addressing one of the city’s dirtiest little secrets – the discharge of literally hundreds of millions of gallons of untreated sewage and stormwater into Casco Bay every year.

This discharge is a result of stormwater overwhelming the city’s sewer system. In order to relieve that pressure, the city had a system of combined sewer overflows, or CSOs, that would bypass the normal treatment facility in the East End and discharge sewage and stormwater directly into Casco Bay. That toxic brew has closed shellfish harvesting areas in Casco Bay and kept the East End beach closed on many a day.

Since 1993, the city has been obligated by an administrative consent agreement with the Department of Environmental Protection to remove the CSOs, but for many years has dragged its feet. However, in recent years, with a mix of state and federal funding, the city has made significant progress, and has changed the focus from removing the CSOs to providing greater storage for the first flush of the stormwater/sewage brew so that it can be treated after the storm event and capacity opens back up at the East End treatment facility.

To achieve that goal will be expensive – current estimates are that the remaining work on CSOs will exceed $125 million and other related work could bring the price tag up to $170 million. City staff had recommended that work be spread out over 25 years; however, after testimony by CLF and others, including the Casco Baykeeper and Friends of Casco Bay, City Council rejected that notion and adopted the 15-year schedule that CLF had recommended. And that is a good result for the health of Casco Bay.

MassHighway finally starts to clean up its act—and our waterways

On April 14 U.S. District Court Judge William G. Young issued a final judgment in CLF’s favor in our suit against the MassHighway Department, bringing to a close nearly five years of litigation to push the department to manage stormwater runoff from state roads that was polluting nearby waterbodies. The court found that MassDOT (which now includes MassHighway) is finally, sufficiently carrying out its obligations. As a result of CLF’s suit, MassHighway has now built new stormwater treatment measures at the three sites that were contributing to discharges that cause on occasion instream exceedance of water quality standards. In addition, it submitted a revised Storm Water Management Plan that addressed the numerous deficiencies in the original plan which the court approved. The court noted, however, that MassHighway has more work to do. MassHighway has committed to assess its storwmater impacts on over 600 locations over a five-year schedule and to install new treatment if necessary.  MassHighway will have to submit two more reports to the Court detailing its activities throughout 2011.

When CLF filed suit in 2006, MassHighway had not even obtained permit coverage for its stormwater from EPA as required under the Clean Water Act. Two years later, in 2008, Mass Highway had done nothing to comply with the federal court order to clean up three sites in Milford, Franklin and Lancaster, Massachusetts, and had not revised its statewide cleanup plan for degraded waters.  CLF took MassHighway back to court, and at a hearing in May, 2010, Judge Young called MassHighway to the mat for non-compliance with federal law and issued an order to begin the cleanup immediately. At long last, the Judge issued a final judgment in CLF’s favor. This lawsuit sets a precedent for how stormwater is managed, on MassHighway’s remaining 2,500 miles of roadways in Massachusetts and the 600+ locations throughout the state where stormwater is being dumped into degraded rivers, lakes, and streams. The true measure of our success, however, is cleaner water. One important thing to note is that Judge Young, in the court’s final judgment, explicitly said this does not preclude suits for future violations so you can be sure CLF will be closely monitoring MassHighway for years to come. A “Green” Facelift for The Big Apple’s Waterfront

Yesterday, New York City Mayor Michael Bloomberg announced the city’s 10-year Waterfront Vision and Action Agenda.  New England cities should take note of this forward-thinking plan, which knits together a dizzying array of restoration activities to ensure that NYC’s rivers, harbors and 500-mile waterfront remain world class amenities for its residents and visitors.

The waterfront plan incorporates key elements of NYC’s Green Infrastructure Plan, released last September.

Among other things, NYC plans to invest over $4 billion over the next 20 years in modernizing infrastructure to control pollution to the city’s waterways.  Recognizing it would need to invest huge sums to protect and enhance its critically valuable waterfront, the city did its homework.  Experts found that using green infrastructure approaches to reduce sewer overflows over the 20 years would result in cost savings of $1.5 billionNYC’s vision for restoring water quality now includes a mix of strategic investments in some “grey” or hard piped infrastructure – the sort cities have employed for the past century – along with a hefty proportion of green technologies.  In addition, the plan includes $900 million in private investment.

One inch at a time

Green stormwater management techniques, often referred to as “Low Impact Development,” model nature’s way of handling runoff from paved areas during storms – the runoff is cleansed by soil and plants in vegetated areas, then evaporates or is filtered back into the ground.  Wetlands, green roofs and even specially designed rain gardens and street trees can serve this function.  Dumping polluted stormwater runoff into natural wetlands isn’t on its own an acceptable solution, so green infrastructure approaches add new vegetated areas where the treatment occurs.

The status quo is that street runoff co-mingles with human wastewater in the sanitary sewer system, overwhelming the pipes and treatment plants.  Instead, the city plans to send street runoff into new green treatment areas designed to manage stormwater.  NYC has set its sights on diverting runoff from the first inch of rainfall from 10% of paved area. Keeping this quantity of runoff out of the combined sewer system, experts predict, will have dramatic water quality benefits.

Everybody pays, everybody wins

NYC’s waterfront vision is an impressive example of coordination across a tangle of city and state agencies, public and private entities.  The city’s action plan to cut back sewer overflows relies on public and private entities to restore water quality over the next 20 years.  The city will soon require new development to include state-of-the-art stormwater management, recognizing that private property owners will benefit from the improved waterfront and the public goals cannot be accomplished without their contributions.  If all goes as planned, many more New Yorkers will enjoy views of blue harbors from atop green roofs…

Hold The Salt- On The Road, That Is!

It’s difficult to imagine a day like today in Boston without the aid of salt to make our roads safe to use. For those of us in the snowier parts of the country, road salt is a necessary and accepted part of our winter. It’s cheap, effective and it allows commuters, motorists and emergency vehicles to safely reach their destinations in harsh conditions. According to the Salt Institute, Americans used 22 million tons of road salt in 2008. In a different study by the National Research Council, Massachusetts tops the list of of states with the highest road salt-use at, 19.94 tons per lane-mile each year, surpassing even New York, with 16.6 tons per lane-mile. Under MassDOT salt policy, salt or sodium chloride is applied at 240 pounds per lane-mile. In other words, trucks in Massachusetts are dumping more than a ton of salt every 10 lane-miles in a single application! Salt does not evaporate or otherwise get removed, so one has to ask: what is the fate of all this salt that is dumped on our roads?

Unfortunately, most of it is washed off of roadways by rain runoff and snow melt and enters our rivers and streams or percolates through the soil into our drinking water supplies. That’s the situation that Cambridge, MA has been combating for years. This densely-populated city gets its water from two reservoirs, both located next to Route 128, making it particularly susceptible to salt contamination. Another town suffering from the same issue is Boxford, MA. The town launched a suit against the state highway department, MassHighway, to close its salt storage shed, contending that it was responsible for contaminating at least 30 local wells. Aside from the ecological damage of excess salt, there are also health and financial burdens associated with high salt levels in public and private water supplies. High salt levels can result in skin and eye irritation and pose a danger for individuals with sodium-restricted diets, according to the New England Interstate Water Pollution Control Commission.

MassHighway is already under court order to manage stormwater runoff after CLF’s successful suit in 2008. Hopefully this effort will divert some of the salt from our waters and, in turn, lead to better health for both the environment and the MA residents who live in it.

United States Joins CLF Lawsuit Against Boston Water and Sewer Commission

Today, the U.S. EPA announced that it will join CLF’s lawsuit against the Boston Water and Sewer Commission (BWSC) for violations of the Clean Water Act. The suit, filled by CLF in U.S. District Court in February 2010, states that BWSC has failed to control polluted discharges from its storm water system, allowing it to carry raw sewage and excessive levels of bacterial, copper and zinc into Boston’s waterways, threatening the health and well-being of the surrounding communities.

BOSTON, MA  December 22, 2010 – The Conservation Law Foundation (CLF) has issued the following statement in response to the motion filed today by the U.S. Environmental Protection Agency (EPA) stating that it will join CLF’s lawsuit against the Boston Water and Sewer Commission (BWSC) for violations of the Clean Water Act:

“The complaint against the Boston Water and Sewer Commission documents serious failures in the system that are allowing ongoing unlawful pollution of Boston’s waterways, including the Charles, Mystic and Neponset Rivers, in some the city’s most economically-challenged communities,” said Christopher Kilian, director of CLF’s Clean Water and Healthy Forests program. “The federal government’s entry into this case is a clear indication of the urgency of the matter and the priority EPA places on it. BWSC’s inability to maintain a system that ensures clean water is a violation of the law and an affront to the people of Boston. The United States agrees with CLF that BWSC must make a major commitment now to improve water quality, as other cities have done, and restore these resources to health for everyone’s benefit.” More>>

MA Residents Get the Dialogue Flowing on Stormwater Runoff

In an effort to clean up the Charles River—and as the result of years of CLF advocacy—residents in Bellingham, Franklin, and Milford, MA may soon be obligated to comply with a proposed EPA mandate to reduce phosphorus runoff by 65 percent. As with most important initiatives to restore our environment, implementing this program will cost money, and there are constituencies opposed.  This Milford Daily News article chronicles some of the factors at stake and how residents have reacted to the news.

What’s most exciting about the public dialogue is to see that the discussions have advanced to real thinking about HOW to finance cleanups through stormwater utilities and other fee structures for reducing polluted runoff.  In Massachusetts, polluted runoff is the number one cause of water pollution.  Conversations about how to secure dedicated funding to solve the problem have generally only happened in a few communities under enforcement orders. They had to sort out issues of what’s fair, what’s practical, and what’s most palatable to residents in order to finance the fixes.  Now we’re seeing similar discussions in more communities where new stormwater regulations are proposed. These communities can serve as a model of forward-thinking investment in the clean waters that are critical to a thriving New England.

Going Green To Keep Our Waters Blue

The Massachusetts’ Water Resource Authority’s decision to release 15 million gallons of untreated sewage into Boston Harbor’s Quincy Bay during last weekend’s storm felt to many like a giant step backward in the decades-long fight to clean up Boston Harbor. The good news is that there are actions that can be taken today that could have kept MWRA officials from having to make that decision in the future—implementing green stormwater infrastructure to reduce the burden on our sewer pipes, reduce flooding and make communities more resilient to climate change.

Many of our state’s aging sewer systems become overwhelmed with a mix of rainwater and sewage during large storms. That’s why MWRA officials were stuck between a rock and a hard place, forced to choose between quietly releasing 15 million gallons of untreated sewage into Quincy Bay or letting the water flood the station and release that sewage into basements, but sparing the Harbor. The problem runs deeper than this one incident—during last week’s storm, there were equally damaging releases of raw sewage into neighborhoods and into the Mystic and Charles Rivers as well. Massachusetts can stop these incidents by investing in green stormwater management techniques to enable communities to better prevent sewer overflows and save money over the long term. Some of these techniques include the use of permeable pavement, green roofs, rain barrels, even gravel—anything that will absorb stormwater and diminish runoff from hard surfaces. These actions can be taken by homeowners in and around their homes, at the city scale by greening streets, parking lots, and alleys, and at the state level, by greening state highways and universities.  Massachusetts residents can urge their towns to adopt bylaws requiring green stormwater and green building techniques to be used in all new construction or infrastructure projects. Cities like Philadelphia, Chicago, and New York are already rolling out these techniques and finding that they are both cost-effective and environmentally sustainable.

Fortunately, we have a chance RIGHT NOW to tell the state of Massachusetts how important it is to us to keep stormwater in check. The U.S. EPA is currently working on a stormwater permit that will govern the stormwater management of communities across Massachusetts for the next five years.

Help Massachusetts prepare for the next storm before it happens. Tell our government that we need a stronger stormwater permit to govern Massachusetts waterways and keep our communities pollution-free.
