CRWA Honors CLF’s Champion for the Charles

There is no greater honor than to be recognized by your peers for the important work that you do. CLF’s Clean Water and Healthy Forest program director, Christopher Kilian, received such an honor last week at the Charles River Watershed Association’s annual meeting, where CRWA presented him with the 2011 Anne M. Blackburn Award. The award is “presented annually to an individual who has made significant contributions over a career that have resulted in singular improvements for the Charles River, its watershed and our natural environment.”

CLF is extremely proud of the clean water work that Chris and his team have done and continue to do in collaboration with CRWA and numerous other watershed partners. You can read more about this award-winning work elsewhere on our web site (e.g., cleaning up polluted highway runoff and polluted runoff from parking lots and other commercial development, and securing an agreement to prevent super-heated water discharges into the Charles from a nearby power plant). Here, however, I want to share with you some inspiring excerpts from the speech Chris delivered to an appreciative audience at the award ceremony:

We must all stand up for the basic notion of equal access to justice, including the courts, to vindicate the public interest in a healthy environment. I applaud CRWA for its willingness to stand up for clean water, including in the courts when necessary.

But the words of the law ring hollow unless they are connected to people and a place. No organization is more effectively connected to a place on earth than CRWA. Here on the Charles, my own evolving sense that an urban river can be a thriving ecological system and community amenity has been further inspired by the decades of incredible work of CRWA. CRWA’s ideal of blue cities where clean, healthy waters are present even in the densest urban areas, is a vision that is changing the world. Instead of dangerous dumping grounds, our urban waters will cool us as we safely swim in the summer, feed us as we catch fish and shellfish with our children, leave us awestruck in the presence of habitat for nature’s great bird migrations and creatures great and small, and provide a needed release as we sail, boat, and enjoy these great natural amenities.

Some, even government leaders in Massachusetts, say our work to protect clean water is done. They say that clean water is not worth the cost. They say removing raw sewage from our waters (a job that still remains unfinished) is all that the Clean Water Act demanded.  This cannot be the case. It cannot be that the Charles will suffer a fate overrun with toxic metals, raw sewage, and toxic blue green algae blooms. I am confident that with all of you, with CRWA, and CLF working together our waters will not be left degraded. Thank you to CRWA’s supporters, please continue your support. Our work is more important now than ever.

Join CLF at Bloom screening March 24 in Montpelier

Over the last several months the documentary Bloom: The Plight of Lake Champlain has been shown to capacity audiences around Vermont, from the State House to the Echo Lake Aquarium and Science Center.

Now the movie, which powerfully brings home the effect of too much phosphorous pollution on Lake Champlain, will be part of the Green Mountain Film Festival in Vermont.

Bloom, which features CLF Vermont Director Chris Kilian, will be shown at Montpelier’s Pavilion Auditorium at 6:15 p.m. Thursday, March 24th and will be followed by a panel discussion which will include CLF Lake Champlain Lakekeeper Louis Porter.

The documentary combines narration, interviews and footage to convey both the severity and significance of the problem of uncontrolled algae and weed growth in Lake Champlain, and the need to quickly find effective solutions.

A “Green” Facelift for The Big Apple’s Waterfront

Yesterday, New York City Mayor Michael Bloomberg announced the city’s 10-year Waterfront Vision and Action Agenda.  New England cities should take note of this forward-thinking plan, which knits together a dizzying array of restoration activities to ensure that NYC’s rivers, harbors and 500-mile waterfront remain world class amenities for its residents and visitors.

The waterfront plan incorporates key elements of NYC’s Green Infrastructure Plan, released last September.

Among other things, NYC plans to invest over $4 billion over the next 20 years in modernizing infrastructure to control pollution to the city’s waterways.  Recognizing it would need to invest huge sums to protect and enhance its critically valuable waterfront, the city did its homework.  Experts found that using green infrastructure approaches to reduce sewer overflows over the 20 years would result in cost savings of $1.5 billionNYC’s vision for restoring water quality now includes a mix of strategic investments in some “grey” or hard piped infrastructure – the sort cities have employed for the past century – along with a hefty proportion of green technologies.  In addition, the plan includes $900 million in private investment.

One inch at a time

Green stormwater management techniques, often referred to as “Low Impact Development,” model nature’s way of handling runoff from paved areas during storms – the runoff is cleansed by soil and plants in vegetated areas, then evaporates or is filtered back into the ground.  Wetlands, green roofs and even specially designed rain gardens and street trees can serve this function.  Dumping polluted stormwater runoff into natural wetlands isn’t on its own an acceptable solution, so green infrastructure approaches add new vegetated areas where the treatment occurs.

The status quo is that street runoff co-mingles with human wastewater in the sanitary sewer system, overwhelming the pipes and treatment plants.  Instead, the city plans to send street runoff into new green treatment areas designed to manage stormwater.  NYC has set its sights on diverting runoff from the first inch of rainfall from 10% of paved area. Keeping this quantity of runoff out of the combined sewer system, experts predict, will have dramatic water quality benefits.

Everybody pays, everybody wins

NYC’s waterfront vision is an impressive example of coordination across a tangle of city and state agencies, public and private entities.  The city’s action plan to cut back sewer overflows relies on public and private entities to restore water quality over the next 20 years.  The city will soon require new development to include state-of-the-art stormwater management, recognizing that private property owners will benefit from the improved waterfront and the public goals cannot be accomplished without their contributions.  If all goes as planned, many more New Yorkers will enjoy views of blue harbors from atop green roofs…

New Leak, New Lies at Vermont Yankee?

Just days after Vermont regulators concluded hearings on its investigation of leaks at the Vermont Yankee Nuclear Power facility, there are reports of more tritium pollution in the groundwater.

The Vermont Health Department reports that contamination was found in a new well.  The location is different from the site of the pollution from the previous leak.  It also reports that contamination has been “trending upward” at this well since late December.

The new findings belie the corporate claims during the hearings that the leaks are repaired and the site is cleaned up.   Could this be a new leak and a new lie from our “trusted” friends at Vermont Yankee?

CLF sees hope at last for Lake Champlain in EPA decision to update water quality plan

MONTPELIER, VT January 24, 2010 – The Conservation Law Foundation (CLF) has issued the following statement in response to today’s decision by the U.S. Environmental Protection Agency to withdraw its approval of Vermont’s 2002 water quality plan for Lake Champlain. The decision comes almost two years after CLF first challenged EPA’s approval of the Plan in federal court.

“Today’s decision by the EPA to re-examine Vermont’s water quality plan for Lake Champlain is the key to bringing the Lake back to health,” said Louis Porter, CLF’s Lake Champlain Lakekeeper. “The EPA has reviewed the existing pollution budget and concluded, correctly, that there has not been enough improvement in the health of Lake Champlain under the current plan. Now, with a new administration in Vermont and a new water quality plan on the way, Vermont can begin a new, science-based approach to cleaning up Lake Champlain and making sure it remains a safe and enjoyable resource for swimmers, boaters, anglers, and the more than 200,000 people for whom it provides drinking water.” More >

Hold The Salt- On The Road, That Is!

It’s difficult to imagine a day like today in Boston without the aid of salt to make our roads safe to use. For those of us in the snowier parts of the country, road salt is a necessary and accepted part of our winter. It’s cheap, effective and it allows commuters, motorists and emergency vehicles to safely reach their destinations in harsh conditions. According to the Salt Institute, Americans used 22 million tons of road salt in 2008. In a different study by the National Research Council, Massachusetts tops the list of of states with the highest road salt-use at, 19.94 tons per lane-mile each year, surpassing even New York, with 16.6 tons per lane-mile. Under MassDOT salt policy, salt or sodium chloride is applied at 240 pounds per lane-mile. In other words, trucks in Massachusetts are dumping more than a ton of salt every 10 lane-miles in a single application! Salt does not evaporate or otherwise get removed, so one has to ask: what is the fate of all this salt that is dumped on our roads?

Unfortunately, most of it is washed off of roadways by rain runoff and snow melt and enters our rivers and streams or percolates through the soil into our drinking water supplies. That’s the situation that Cambridge, MA has been combating for years. This densely-populated city gets its water from two reservoirs, both located next to Route 128, making it particularly susceptible to salt contamination. Another town suffering from the same issue is Boxford, MA. The town launched a suit against the state highway department, MassHighway, to close its salt storage shed, contending that it was responsible for contaminating at least 30 local wells. Aside from the ecological damage of excess salt, there are also health and financial burdens associated with high salt levels in public and private water supplies. High salt levels can result in skin and eye irritation and pose a danger for individuals with sodium-restricted diets, according to the New England Interstate Water Pollution Control Commission.

MassHighway is already under court order to manage stormwater runoff after CLF’s successful suit in 2008. Hopefully this effort will divert some of the salt from our waters and, in turn, lead to better health for both the environment and the MA residents who live in it.

The View from the Corner Office

The view from the corner office at CLF Boston is not always glamorous.  For the past few days, the sights and sounds outside our building on Summer Street have been dominated by environmental remediation trucks.  With their humming, rattling pumps, hoses and generators, it’s admittedly been a little distracting to those of us on the other side of the windows.

However, it’s a welcome intrusion to those of us who know what’s going on under the surface of the street.  The trucks are performing vital maintenance on the underground storm sewers that pipe rainwater from our streets into rivers and out to sea.  When the catch basins under the street grates become clogged with debris and leaves, they no longer trap trash and pollutants as designed.  So regular clean-outs (often done with a large vacuum truck) are vital.  And the network of sewer pipes under the City of Boston (like many municipalities) is aging and needs repair as well.  Rumor has it that cameras are being installed to monitor for leaks or cracks in the pipes underground.

As an organization that’s spent decades fighting for clean water throughout New England, the maintenance of the water infrastructure right under our feet is one of those scenes that, quite literally, drives the original goals–and results–of our advocacy home.

MA Residents Get the Dialogue Flowing on Stormwater Runoff

In an effort to clean up the Charles River—and as the result of years of CLF advocacy—residents in Bellingham, Franklin, and Milford, MA may soon be obligated to comply with a proposed EPA mandate to reduce phosphorus runoff by 65 percent. As with most important initiatives to restore our environment, implementing this program will cost money, and there are constituencies opposed.  This Milford Daily News article chronicles some of the factors at stake and how residents have reacted to the news.

What’s most exciting about the public dialogue is to see that the discussions have advanced to real thinking about HOW to finance cleanups through stormwater utilities and other fee structures for reducing polluted runoff.  In Massachusetts, polluted runoff is the number one cause of water pollution.  Conversations about how to secure dedicated funding to solve the problem have generally only happened in a few communities under enforcement orders. They had to sort out issues of what’s fair, what’s practical, and what’s most palatable to residents in order to finance the fixes.  Now we’re seeing similar discussions in more communities where new stormwater regulations are proposed. These communities can serve as a model of forward-thinking investment in the clean waters that are critical to a thriving New England.

More lies and more pollution at Vermont Yankee

There is no surprise that tritum has reached the drinking water aquifer at Vermont Yankee.  The claimed surprise by both Vermont Yankee officials and state officials cannot be genuine.  

In June, CLF filed testimony stating:  “every indication is that the bedrock is, or soon will be, contaminated by tritium.”  CLF’s expert hydrogeologist reviewed Vermont Yankee’s groundwater data and analysis and concluded that the tritium is deep in the groundwater and has been there for months.  This  “represents clear evidence that radionuclides released from VY … have reached the bedrock surface, and threaten the water supply aquifer beneath it.”  (p. 19-20).

Water flows down and downstream.  Any grade schooler will tell you this.  Sadly, rather than step up to acknowledge and clean up the pollution, we are getting more lies about the leaks.  It is no surprise the aquifer is contaminated.  Vermont Yankee knew this in June.  Why are they lying now?
