The water is used in the plant for cooling, and “waste heat from the boilers ends up in the cooling waters, which are then discharged,” as Irwin explained. Impingement occurs when fish are sucked up and smashed into grates in the river meant to prevent logs and other debris from entering the plant. Oftentimes, the delicate fish are killed on impact.
“The decision not to regulate more of these toxic chemicals in our water is deeply disturbing,” said Jen Duggan, Vice President and Director of CLF Vermont. “It doesn’t make sense to continue this whack-a-mole approach to removing these chemicals from drinking water. People’s health will suffer as a result of this decision.”

“This has been a long and contentious road to reduce nitrogen pollution in the estuary,” Paly said. “After many, many years, it’s really gratifying to see municipalities coming together, working more collaboratively with CLF and other stakeholders to start down a new path, and hopefully the estuary will be the better for it.”

“This is an important public health matter,” said James Crowley, staff attorney for the Conservation Law Foundation in Rhode Island. “It is long past time to take action, and we hope that the incoming administration will prioritize this and move ahead with regulations that are protective of public health.”
“This settlement means the owners of the Devens site are addressing stormwater pollution at Devens in compliance with the Clean Water Act,” said Christopher Kilian, Vice President of Strategic Litigation at CLF. “MassDevelopment now has a legally enforceable permit that ensures it will follow Clean Water Act pollution requirements. MassDevelopment’s and Devens Enterprise Commission’s commitment to green improvements to the site’s stormwater system will result in a healthier Nashua River and surrounding waters.”
“A company responsible for transporting children safely cannot be allowed to ignore the law,” said Heather Govern, Director of CLF’s Clean Air and Water program. “ All-Star and STA must stop violating anti-idling laws and exposing the public to dangerous levels of tailpipe exhaust. All Connecticut residents have a right to clean air.”
CLF is asking the court to rule that Barnstable is in violation of the Clean Water Act: This would trigger the requirement of a federal permit, which comes with stricter limits on nutrients and other contaminants.
