CLF Acts Fast to Preserve Claremont’s Victory Over Dangerous Waste Proposal 

Pre-emptive appeal keeps every threat to Claremont in the spotlight

June 23, 2025 (Concord, NH) – Conservation Law Foundation (CLF) has filed a Notice of Appeal to safeguard Claremont’s recent victory over Acuity Management. Last month, state officials rejected the proposal for a massive construction and demolition waste site after finding it would block local roads daily and violate state safety rules. Acuity’s owner has already told reporters he will challenge that decision “lickety split.”  

“Claremont families shouldn’t have to gamble their health on legal technicalities,” said Heidi Trimarco, CLF staff attorney. “By filing first, we’re making sure every risk the community raised – from air pollution to hazardous runoff – will stay in the record.” 

CLF’s move means the Waste Management Council will also hear about other dangers neighbors raised, not just the traffic issues. 

“Acuity’s project isn’t just a traffic hazard – it threatens to contaminate a community that has repeatedly told the company to go elsewhere. Claremont has said again and again that it does not want a dirty waste operation in a residential neighborhood,” Trimarco added. 

Acuity’s proposal to turn a small, 1980’s era, recycling center into a massive construction and demolition waste site would have brought up to 130,000 tons of waste per year –about 2,500 times the site’s current volume – into a residential neighborhood, raising serious concerns about environmental pollution, truck traffic, and public health risks.  

Following rejections by the Claremont Zoning Board, Planning Board, Conservation Commission, and City Council, the State denied Acuity’s permit in May. CLF’s appeal ensures the community’s victory remains, and it prevents the developer from narrowing the case.
